Who you are dealing with
Charlie and Me Sensory (ABN 16 909 933 836), trading as Charlie & Me Handcrafted Sensory Tubs, is a small business operating from Echuca, Victoria, Australia. Anything these terms do not answer can be asked at [email protected]. Nothing in these terms excludes, restricts or modifies any right or guarantee you have under the Australian Consumer Law that cannot lawfully be excluded.
Orders and payment
- All prices are in Australian dollars.
- Online card payments are not switched on yet. Placing an order through the site sends us an order request; we confirm it, and payment arrangements, by email. No money is taken through the site, and an order is only accepted once we confirm it. When online payments launch, payment will be taken at checkout by our payment provider and these terms will be updated.
- We may decline an order, for example if an item cannot be made, your delivery address is outside Australia, or a clear pricing mistake slipped through. If a pricing error affects an order you have placed, we will contact you before anything is made, charged or posted and you can cancel without cost.
- Order confirmations and tracking are sent to the email address you give us, so please make sure it is correct.
Made to order and what that means
Every tub is handmade to order, usually within 3 working days. Small variations in felt stitching, wood grain and colour are part of a handmade product, not a fault. Where a listed material is unavailable, we may substitute like for like in quality and safety; anything more noticeable and we will check with you first.
Delivery
We deliver within Australia only, by tracked Parcel Post or Express Post, priced by the weight of your order at checkout. Parcel Post is free on orders over $150.00. Full timeframes and detail live on the Delivery and Returns page, which forms part of these terms.
Returns, refunds and your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If a product is faulty, unsafe, not as described or not of acceptable quality, you are entitled to a repair, replacement or refund as the law provides. We do not offer refunds, returns or exchanges for change of mind: our products are handmade for children’s sensory play and cannot be accepted back for hygiene and safety reasons where there is no fault. Safety and supervision
- Sensory tubs are play equipment, not childcare. An adult must supervise every play session.
- The age guidance on each product page is part of these terms. “Taste safe” means a curious mouthful will not harm; it does not mean the contents are food.
- The care and safety notes included with each tub (and on its product page) must be followed, including retiring wet filler and checking pieces for wear.
Accounts
Accounts are for people 18 and over. Keep your sign in details to yourself and tell us if you think someone else has used your account. You are responsible for keeping your details accurate; we may close accounts used to abuse the site, place fraudulent orders or harass anyone.
Custom orders
Custom tubs are quoted individually by email. As with the rest of the range, change of mind returns are not offered; your Australian Consumer Law rights for faulty goods always apply.
Using the site
The words, photographs, illustrations and branding on this site belong to Charlie & Me and cannot be reused commercially without permission. Please do not misuse the site: no attempting to access other people’s accounts or our admin area, no scraping and no using the contact or checkout forms to send spam or false orders.
Liability
To the extent permitted by law and except for the consumer guarantees that always apply, our liability for any claim connected with a product is limited to replacing it, supplying an equivalent, or refunding what you paid; and we are not liable for loss caused by events outside our reasonable control, such as postal delays. Nothing in this section limits liability that cannot lawfully be limited, including for goods of a kind ordinarily acquired for personal use.
The housekeeping
- These terms are governed by the laws of Victoria, Australia, and disputes belong to the courts there.
- If part of these terms turns out to be unenforceable, the rest still stands.
- We may update these terms from time to time; the version on this page at the time you place an order is the one that applies to it. Significant changes will be flagged to account holders by email.
